HealthBouk Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and HealthBouk Inc. (“HealthBouk,” “we,” “us,” or “our”) governing your access to and use of the HealthBouk website, mobile application, and any related services (collectively, the “Services”).

By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services. We may update these Terms from time to time without prior notice. Your continued use of the Services after any changes indicates your acceptance of the updated Terms.

1. License

HealthBouk grants you a personal, worldwide, non-exclusive, non-transferable, revocable, limited license to access and use the Services for the sole purpose of storing, managing, and sharing health records for your child or children, strictly in accordance with these Terms.

This license automatically terminates if you breach these Terms, and you must immediately cease use of the Services and delete any downloaded materials in your possession. Except for this limited license, no other rights or licenses are granted under any patents, trademarks, copyrights, or other intellectual property rights.

2. Usage Restrictions

You agree not to:

• Violate any applicable laws or regulations, including privacy and data protection laws.
• Attempt to access accounts, data, or systems without authorization.
• Use the Services to store, upload, or share any content you do not have the legal right to share.
• Upload viruses, malware, or other harmful code.
• Interfere with or disrupt the Services, servers, or networks.
• Use automated tools (e.g., bots, scrapers) without our prior written consent.
• Reproduce, copy, sell, resell, or commercially exploit any portion of the Services without our written consent.
• Misuse the Services in a way that could harm minors’ privacy or safety.

3. Electronic Communications

By using the Services, you consent to receive communications from us electronically, including by email, in-app notifications, or by posting notices in the Services. You agree these communications satisfy any legal requirement that they be in writing.

4. Intellectual Property

The Services and all content, technology, and intellectual property rights are owned by or licensed to HealthBouk and are protected by applicable laws. You may not use our trademarks, service marks, trade names, or logos without our prior written consent.

5. User Content

You may upload or submit health-related records and other content (“User Content”) to the Services. You retain ownership of your User Content, but by submitting it, you grant HealthBouk a non-exclusive, worldwide, royalty-free license to store, process, and display it solely to provide the Services and fulfill your sharing instructions.

You represent and warrant that:

• You have lawful authority to provide the User Content (including on behalf of your child).
• The User Content is accurate and lawful.
• Your submission and our use of it will not violate any third-party rights or applicable laws.

6. No Medical Advice

The Services are not a substitute for professional medical advice, diagnosis, or treatment. You acknowledge that HealthBouk does not provide medical care and is not responsible for any decisions you make based on information stored or shared through the Services. Always seek advice from qualified healthcare providers.

7. Privacy

Your use of the Services is subject to our Privacy Statement, which explains how we collect, use, and protect your personal information.

8. Account Registration & Security

Some features require you to register for an account. You agree to:

• Provide accurate and complete information.
• Maintain the confidentiality of your account credentials.
• Accept responsibility for all activities under your account.
• Immediately notify us of unauthorized use of your account.

Accounts are for personal use by parents or legal guardians; you may not share your account with unrelated parties.

9. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms, engaged in unlawful activity, or compromised the privacy or security of others. Upon termination, your right to use the Services ends immediately.

10. Indemnification

You agree to indemnify and hold harmless HealthBouk, its officers, directors, employees, affiliates, agents, and licensors from any claims, damages, liabilities, costs, or expenses arising out of your violation of these Terms or misuse of the Services.

11. Disclaimers & Limitation of Liability

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. HealthBouk does not warrant uninterrupted or error-free operation. To the fullest extent permitted by law, HealthBouk disclaims all liability for damages arising from your use of or inability to use the Services.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
